Terms of service

1. The agreement

These terms are between you (the business using FiskIT) and Hungwaru Smart Technology, 8220 Southview Park, Harare, Zimbabwe (“we”). By registering, connecting a device or connecting QuickBooks Online, you accept them. If you bought FiskIT through a tax consultant, your consultant’s own terms with you also apply, but these terms govern your use of the service.

2. What FiskIT does

FiskIT signs your invoices, receipts, credit and debit notes with your ZIMRA fiscal device and submits them to ZIMRA’s Fiscalisation Data Management System. If you connect QuickBooks Online, FiskIT fiscalises new invoices, sales receipts, credit memos and refund receipts automatically and writes the ZIMRA verification link back to each one. It also provides an online portal with your fiscal records and reports.

3. Your responsibilities

• Give accurate business, device and customer details, and keep them up to date.
• Make sure what you record in your till or QuickBooks is correct before it is fiscalised. A fiscalised document cannot be edited: corrections need a credit or debit note.
• Keep your logins, devices and certificates secure, and tell us promptly about any misuse.
• Remain responsible for your own tax obligations to ZIMRA, including VAT returns and keeping records. FiskIT is a tool to help you comply, not a substitute for doing so.

4. Fees

Registration and licence fees are as quoted to you by us or your FiskIT reseller. Licence fees are payable monthly in advance. If a licence fee is not paid, we may stop signing for the affected device after giving notice; you are then responsible for fiscalising by other means.

5. QuickBooks Online

Connecting QuickBooks is optional. By connecting, you authorise us to access your QuickBooks company as described in our privacy policy. Only documents created after you connect are fiscalised. You can disconnect at any time from QuickBooks or by asking us; documents already fiscalised stay fiscalised. QuickBooks is Intuit’s product and Intuit’s own terms apply to it.

6. Availability and changes

We aim to keep FiskIT available at all times but do not guarantee uninterrupted service; ZIMRA’s systems, Intuit’s systems, power and network outages are outside our control. Documents that cannot be signed straight away are retried automatically. We may improve or change the service and will give reasonable notice of changes that materially affect you.

7. Liability

FiskIT’s reports and forecasts are for information only and are not tax advice. To the extent the law allows, we are not liable for indirect or consequential loss, or for penalties arising from information you supplied, and our total liability in any 12 months is limited to the fees you paid us in that period. Nothing here limits liability that cannot be limited under Zimbabwean law.

8. Ending the service

You may stop using FiskIT at any time. We may suspend or end your access if you breach these terms or do not pay. On ending, we keep fiscal records for as long as the law requires and handle other data as our privacy policy describes.
